The purpose of these General Terms and Conditions of Use (hereinafter "GTCU") is to define the terms and conditions under which SAS Swwitch, a simplified joint stock company with capital of €5,000, registered in the Lyon Trade and Companies Register under no. 890 284 433, whose registered office is located at 14A rue du Vallon d'or, 69370 Saint-Didier-au-Mont-d'Or (hereinafter " Swwitch "), provides a platform enabling :
principal tenants (hereinafter referred to as "Lessors") to entrust the management of their accommodation for temporary subletting,
subtenants (hereinafter referred to as "Users" or "Tenants") to reserve accommodation for a limited period under a mobility lease.
Use of the site www.swwitch.fr (hereinafter referred to as "the Site") implies unreserved acceptance of these terms and conditions.
Swwitch acts as a real estate agent holding professional card no. CPI69012023000000041, issued by the Lyon Métropole Saint-Étienne Roanne Chamber of Commerce and Industry, enabling it to carry out property management activities.
As such, Swwitch :
provides rental management services for properties entrusted to us by landlords (ad creation, reservation management, check-in/out, cleaning, maintenance), in accordance with the signed management mandate,
signs a furnished mobility lease with subtenants, in compliance with law no. 89-462 of July 6, 1989.
Swwitch is not a party to the main lease between the owner and the lessor, but acts as a legal and secure intermediary.
Access to the service is reserved for :
lessors who have obtained written permission from their landlord to sublet their property,
subtenants who meet the criteria for a mobility lease (students, trainees, people on temporary assignments, etc.).
Each User agrees to provide accurate, complete and up-to-date information when registering and when dealing with Swwitch.
In particular, lessors undertake to :
provide accommodation that is in good condition and complies with legal standards,
guarantee that the property is free of any legal proceedings and covered by home insurance,
provide Swwitch with essential equipment (internet connection, basic bedding, kitchen utensils),
hand over at least three sets of keys to Swwitch,
respect the exclusive management rights entrusted to Swwitch for the duration of the mandate.
Subtenants undertake in particular to:
pay rent and utilities as agreed,
use the property peacefully and maintain it regularly,
respect the inventory and return the accommodation in good condition,
insurance against rental risks (tenant's liability),
not to sell or sublet the property in turn.
In particular, Swwitch undertakes to:
provide the lessee with housing in good condition and ensure peaceful enjoyment of the property,
intervene in the event of technical or maintenance problems,
compensate the lessor for any damage caused by the sub-tenant, in accordance with the terms of the management agreement,
act as a diligent professional in the management of assets.
Rents are fixed in the mobility lease and payable monthly in advance.
A one-off entry fee of €149 is charged to lessors on subletting, covering photo shoots and initial cleaning.
A security deposit equivalent to one month's rent (excluding charges) may be requested from the sub-tenant and returned within a maximum of one month after departure, less any deductions for damage or unpaid bills.
Late payment will incur a penalty of €10 per day of delay.
Subtenants are responsible for any damage caused during their occupancy, except in cases of force majeure or construction defects.
Swwitch will replace or reimburse items damaged by subtenants, in accordance with the management mandate.
Lessors remain responsible for the structural compliance of the property (plumbing, electricity, safety).
Swwitch may only be held liable in the event of proven and direct fault in the performance of its obligations.
Contracts may be terminated by either party withone month's notice, by e-mail or registered post.
Swwitch reserves the right to immediately terminate the contract and/or suspend access to its services in the event of serious misconduct (non-payment, non-compliance with obligations, prohibited subletting, unsanitary accommodation, etc.).
Swwitch collects and processes personal data in accordance with the General Data Protection Regulation (GDPR).
The data collected is used solely for the purpose of managing accommodation and sublets.
Users have the right to access, rectify and delete their data, by sending a request to: hello@swwitch.fr.
All information exchanged between the parties in connection with the use of Swwitch's services is strictly confidential and may only be disclosed in the event of a legal obligation.
The present GCU are governed by French law.
Any dispute relating to their validity, interpretation or execution will be submitted to the competent jurisdictions of the Commercial Court of Lyon, except for imperative provisions protecting the consumer.
