The purpose of these Terms of Use (hereinafter “TOU”) is to define the terms and conditions under which SAS Swwitch, a simplified joint-stock company with a capital of €5,000, registered with the Lyon Trade and Companies Register under No. 890 284 433, with its registered office located at 14A rue du Vallon d’Or, 69370 Saint-Didier-au-Mont-d’Or (hereinafter “Swwitch” ), provides a platform that allows:
to allow primary tenants (hereinafter “Landlords”) to entrust the management of their housing for temporary subletting,
to subtenants (hereinafter “Users” or “Tenants”) to reserve housing for a limited period under a mobility lease.
Use of the Site www.swwitch.fr (hereinafter “the Site”) implies unconditional acceptance of these Terms of Use.
Swwitch acts as a real estate agent holding professional license no. CPI69012023000000041, issued by the Lyon Métropole Saint-Étienne Roanne Chamber of Commerce and Industry, which authorizes it to engage in real estate management.
In this capacity, Swwitch:
handles the rental management of properties entrusted by landlords (creating listings, managing reservations, check-in/check-out, cleaning, maintenance), in accordance with the signed management agreement,
enters into a furnished short-term lease with the subtenants in accordance with Law No. 89-462 of July 6, 1989.
Swwitch is not a party to the main lease agreement between the property owner and the tenant, but acts as a legal and secure intermediary.
Access to the service is restricted to:
to tenants who have obtained written permission from their landlord to sublet their apartment,
to subtenants who meet the criteria of the mobility lease (students, interns, individuals on temporary assignments, etc.).
Each user agrees to provide accurate, complete, and up-to-date information when registering and in all communications with Swwitch.
In particular, the donors undertake to:
provide housing that is in good condition and meets legal standards,
ensure that the property is free of any legal proceedings and covered by home insurance,
provide Swwitch with the necessary equipment (internet connection, basic bedding, kitchen utensils),
provide Swwitch with at least three sets of keys,
respect the exclusive management rights granted to Swwitch for the duration of the term.
The subtenants agree, in particular, to:
pay the rent and utilities in accordance with the agreed terms,
to use the dwelling peacefully and to maintain it on a day-to-day basis,
follow the inventory and return the apartment in good condition,
take out insurance against rental risks (rental liability insurance),
not to sublet or sublease the dwelling themselves.
In particular, Swwitch is committed to:
to provide the tenant with a dwelling in good condition and to ensure the tenant’s undisturbed enjoyment of the property,
step in in the event of a technical issue or maintenance need,
compensate the landlord for any damage caused by the subtenant, in accordance with the terms of the management agreement,
act with due diligence in managing the property.
Rent is set in the mobility lease and is payable monthly in advance.
A one-time registration fee of €149 is charged to landlords when the property is sublet, covering costs such as the photo shoot and initial cleaning.
A security deposit equal to one month's rent (excluding utilities) may be required from the subtenant and will be returned within one month of their move-out, minus any deductions for damage or unpaid rent.
Any late payment will result in a penalty of €10 per day of delay.
Subtenants are liable for any damage that occurs during their tenancy, except in cases of force majeure or structural defects.
Swwitch covers the replacement or reimbursement of items damaged by subtenants, in accordance with the management agreement.
Landlords remain responsible for ensuring that the housing meets structural standards (plumbing, electrical systems, safety).
Swwitch shall only be held liable in the event of proven and direct negligence in the performance of its obligations.
Contracts may be terminated by either party withone month’s notice, via email or certified mail.
In the event of serious misconduct (unpaid bills, failure to meet obligations, unauthorized subletting, unsanitary living conditions, etc.), Swwitch reserves the right to immediately terminate the contract and/or suspend access to its services.
Swwitch collects and processes personal data in accordance with the General Data Protection Regulation (GDPR).
The data collected is used solely for the purpose of managing housing and subleases.
Users have the right to access, correct, and delete their data by submitting a request to: hello@swwitch.fr.
All information exchanged between the parties in connection with the use of Swwitch’s services is strictly confidential and may only be disclosed if required by law.
These Terms of Use are governed by French law.
Any dispute regarding their validity, interpretation, or enforcement shall be submitted to the competent courts within the jurisdiction of the Commercial Court of Lyon, unless otherwise required by mandatory consumer protection provisions.
